IMPORTANT: Please read these Terms of Service ("Terms") carefully before using our platform. By registering, browsing, or making any purchase on this platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
NYCLife Platform LLC ("we", "us", "the Platform") operates a local life services platform serving the Chinese community in New York City. The Platform provides an online marketplace where merchants can list promotional offers, and users can purchase and redeem these offers at participating merchant locations.
You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements.
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.
The Platform acts solely as an intermediary marketplace. We do not own, operate, or control any merchant business listed on the Platform. We do not guarantee the quality, safety, legality, or availability of any products, services, or offers listed by merchants.
The Platform does not design, set, or endorse any promotional offer, pricing, or discount. All offers are created and managed solely by the participating merchants. Users acknowledge that any transaction is ultimately between the user and the merchant.
All payments are processed through our third-party payment processor (Stripe). By making a purchase, you agree to Stripe's terms of service. The Platform collects payment on behalf of the merchant and facilitates the transaction. You will receive a unique QR code or redemption code upon successful payment, which can be used once at the designated merchant location within the validity period.
Please refer to our separate Refund Policy document for detailed refund terms. Key points: refund requests must be submitted within the specified refund period before coupon expiration; refunds are processed through the original payment method; processing may take 5-10 business days.
The Platform allows third parties to post job listings, rental listings, and service provider information. The Platform does not verify, endorse, or guarantee the accuracy, legality, or reliability of any such user-generated content. Users are solely responsible for evaluating the information and conducting their own due diligence before entering into any arrangement.
Job listings must comply with all applicable federal, state, and local employment laws, including but not limited to minimum wage requirements, anti-discrimination laws, and work authorization requirements. The Platform reserves the right to remove any listing that appears to violate applicable laws.
Rental listings must comply with the Fair Housing Act and all applicable New York State and City housing regulations. Discrimination based on race, color, religion, sex, national origin, familial status, or disability is strictly prohibited.
All content, design, and technology of the Platform are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION WITH A MERCHANT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the courts located in New York County, New York.
We reserve the right to modify these Terms at any time. Changes will be posted on the Platform with an updated effective date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
